The TDS is run by The Dispute Service under a Government awarded Contract. It is compulsory for tenancy deposits to be registered with a tenancy deposit scheme, designed to safeguard against unfair deductions from the tenants deposit. If a formal dispute arises regarding the condition of the Landlords property, an independent adjudicator is then tasked to assess the facts and evidence provided before any deductions are made. The onus is on the landlord to provide evidence that damage, beyond that of general wear and tear, occurred during the tenancy.

The state of the property when the tenant leaves is then compared to this, and the landlord has hard proof that the changes occurred during the tenancy.
